Case Law in Legal Malpractice Lawsuits

In Otaka, Inc. v. Klein, 71 Haw. 376, 383 (1990), the Hawaii Supreme Court wrote as follows:

"A fiduciary relationship may result because of the nature of the work performed and the circumstances under which confidential information is divulged. Legal consultation occurs when the client believes that he is approaching a lawyer in a professional capacity with a manifest intent to seek professional legal advice. Thus, the deciding factor is what the prospective client thought when he made the disclosure, not what the lawyer thought."

Moreover, the Hawaii Supreme Court recognized that a fiduciary relationship may be created between a lawyer and a prospective client when confidential information is shared by the prospective client and the lawyer.
